1.2 Scope

These General Terms and Conditions apply to all services provided by Stern Restaurant, in particular:

  • Dining at the restaurant

  • Table reservations (by phone and online)

  • Events and functions

  • Takeaway and delivery service

  • Gift vouchers

1.3 Contract Language

The contract language is German.


2. Table Reservations

2.1 Reservation Confirmation

  • Table reservations are only binding upon our confirmation.

  • Confirmations are provided by phone, email, or through our online system.

  • For online reservations, you will receive an automatic confirmation email.

2.2 Reservation Times

  • Reservations are allocated for a maximum of 2.5 hours.

  • For larger groups (8 or more persons), different time arrangements may be agreed upon.

  • Delays exceeding 15 minutes may result in the loss of the reservation.

2.3 Cancellation

  • Cancellations are free of charge up to 24 hours before the reserved time.

  • For later cancellations or no-shows, we reserve the right to charge a cancellation fee.

  • Large groups (10 or more persons): Cancellation up to 48 hours before the reserved time.

2.4 Changes to Party Size

  • Please notify us of any reduction in party size at least 24 hours in advance.

  • Increases in party size are possible subject to availability.

3. Prices and Payment

3.1 Prices

  • All prices include the applicable statutory value-added tax.

  • Prices are subject to change.

  • Current prices can be found on our food and drinks menu.

3.2 Payment Methods

We accept the following payment methods:

  • Cash (EUR)

  • Debit card/Bankomat card

  • Credit cards (Visa, Mastercard)

3.3 Invoicing

  • Invoices are issued at the end of the dining visit.

  • Separate invoices are only possible by prior arrangement.

  • Complaints must be raised immediately, and no later than before leaving the restaurant.

4. Services and Liability

4.1 Food and Beverages

  • All dishes are freshly prepared.

  • Allergens are indicated on our menu.

  • Please inform our staff of any allergies or intolerances.

  • Modifications to dishes are possible where feasible and may incur an additional charge.

4.2 Limitation of Liability

  • We are only liable for damages caused by gross negligence or wilful intent.

  • We assume no liability for personal belongings brought onto the premises.

  • Liability for slight negligence is excluded, unless it concerns injury to life, body, or health.

4.3 Cloakroom

  • Use of the cloakroom is at your own risk.

  • We assume no liability for damage or loss.

5. House Rules and Code of Conduct

5.1 Right of Admission

  • The right of admission is reserved by the restaurant owner and staff.

  • We reserve the right to ask guests to leave the premises in the event of violations of the house rules.

5.2 Code of Conduct

  • Respectful behaviour towards staff and fellow guests is expected.

  • Smoking is only permitted in designated areas.

  • Outside food and beverages are not permitted.

  • Pets are only allowed by prior arrangement.

5.3 Youth Protection

  • We strictly comply with Austrian youth protection regulations.

  • Alcohol is only served to persons aged 16 and over (beer, wine) or 18 and over (spirits).

  • Proof of age may be requested.

6. Events and Functions

6.1 Booking

  • Events for 15 or more persons require a written booking confirmation.

  • A deposit may be required.

  • Menu selection and final headcount must be confirmed 7 days prior to the event.

6.2 Event Cancellation

  • Up to 14 days before the event: free of charge

  • 7–13 days before: 50% of the agreed amount

  • Less than 7 days before: 80% of the agreed amount

  • On the day of the event: 100% of the agreed amount

7. Gift Vouchers

7.1 Validity

  • Gift vouchers are valid for 3 years from the date of issue.

  • Vouchers expire without replacement after the validity period.

  • Gift vouchers cannot be redeemed for cash.

7.2 Usage

  • Gift vouchers may be used for all services offered by the restaurant.

  • No replacement will be provided in the event of loss or damage.

  • Remaining balances will not be paid out.

8. Takeaway and Delivery Service

8.1 Orders

  • Orders can be placed by phone or online.

  • Minimum order value for deliveries: €25.00

  • Delivery fees depend on distance.

8.2 Delivery Times

  • Stated delivery times are estimates.

  • We will inform you in the event of delays.

8.3 Payment

  • Payment upon collection or delivery.

  • Online payment where available.

9. Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy, which is available on our website.

10. Severability Clause

Should any provision of these General Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

11. Applicable Law and Jurisdiction

11.1 Applicable Law

Austrian law shall apply, excluding its conflict-of-law rules.

11.2 Jurisdiction

The place of jurisdiction is Hallein, insofar as the customer is an entrepreneur, a legal entity under public law, or a special fund under public law.

These General Terms and Conditions take effect on 01.01.2025 and apply to Stern Restaurant in Puch bei Hallein. The restaurant has been in operation since 2021.
